DCBIA Complying with COVID-19 Vaccine Mandates

The U.S. Occupational Safety and Health Administration (OSHA) has issued a new and highly controversial Emergency Temporary Standard (ETS) to require employers with 100 or more employees to fully vaccinate their workforce or mandate weekly testing.  After legal battles against the mandate in jurisdictions across the country, on December 17, 2021, the U.S. 6th Circuit Court of Appeals lifted the stay on the OSHA vaccine mandate, clearing the path for the mandate to be enforced nationwide. The case is today before the Supreme Court.

Additionally, Mayor Bowser recently announced a citywide vaccination “VaxDC” mandate for certain indoor establishments in the District of Columbia to verify that their customers, guests, and visitors are vaccinated by January 15, 2022. Health guidance for this requirement has been updated. Office amenity spaces such as gyms are not currently exempt from this requirement.

With local and federal requirements rapidly changing, employers should stay up-to-date.

You will understand the timing of enforcement/citations and the legal status and challenges of this federal requirement. Attendees will also hear from DC Government on the District’s VaxDC mandate to clarify how it differs from an employer mandate, how the mandate applies to office and residential settings, and what exemptions exist.
